Another Purposeful Use

What is Purposeful Use ?

 ‘Purposeful Use’ is any planned or managed use of croft land which does not adversely affect the croft, the public interest, the interests of the landlord or owner(s), or the use of adjacent land. 

Purposeful Use requires the consent of the landlord and so it is important that you approach them initially before carrying out your proposal. If the landlord approves your proposal this may be unconditional or subject to conditions which are acceptable to you, the crofter, and there is no requirement to contact the Commission.

Who can apply?

  • The landlord fails to respond to a request for permission to put all or part of the croft to another purposeful use within 28 days of your request
  • The landlord has refused consent to the proposed other purposeful use
  • The landlord agrees to the other purposeful use but wants to impose conditions unacceptable to you.
 

Please ensure 28 days have passed since contacting your landlord before applying to the Crofting Commission.

To apply to the Commission please complete’ Another Purposeful Use’ application form. 

You will be asked for information about the following

  • Your croft
  • Your details
  • Your landlord, including the date you gave them details of your proposals
  • Why you are applying to the Commission for Another Purposeful Use, making reference where appropriate to the reasons provided by the landlord for refusing your request or any condition(s) the landlord has imposed on their agreement that are unacceptable to you.

You may also include (if applicable):

  • A map or plan of the proposed use
  • A copy of planning consent
  • A copy of correspondence from the Planning Authority confirming that planning consent is not required
  • Evidence that any other permission or consent required for your proposals has been obtained
  • Any evidence of community support.

If there are any inconsistencies between the application and the Crofting Commission’s Register of Crofts, or if the application is not completed correctly, we will be unable to process it.

You can submit your application online or by post. The application form and guidance notes can be accessed using our form finder.

Once the Crofting Commission has received your completed application, we will check to make sure that you have completed the correct form and submitted all the required information.

If you have not submitted everything correctly, you will be made aware and will have a specified amount of time to submit the information requested.
We will make a decision on your application within 28 days of receipt. 

On reviewing ‘Another Purposeful Use’ applications, the Crofting Commission may:

  • Grant consent to the proposals
  • Grant consent but impose conditions as it thinks fit
  • Refuse to grant consent.

The Crofting Commission’s decision can be appealed to the ‘Scottish Land Court’ within 42 days from the date the Commission notify you, your landlord and any other interested parties of its decision.
